1. Acceptance of Terms
By accessing or using Farmly ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. About Farmly
Farmly is an online marketplace connecting local non-GMO farmers and food producers with consumers within a 25-mile radius. Farmly is a marketplace only — we are not a food producer, retailer, or delivery service. Each merchant is independently responsible for their products, food safety, labeling, and compliance with local regulations.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to use Farmly.
4. Orders & Payments
All prices displayed include a platform markup. A 2% service fee is applied at checkout. Delivery orders incur a flat $8.00 delivery fee. Payments are processed securely through Stripe. Farmly never stores your card information.
5. Cancellations & Refunds
You may cancel an order before the merchant confirms it for a full refund. After confirmation, cancellations are at the merchant's discretion. If a merchant cancels your order, you will receive a full refund within 3-5 business days. Disputes are resolved by Farmly administration; decisions are final.
6. Merchant Responsibilities
Merchants on Farmly attest that their products are non-GMO. Farmly is not a certification body and does not independently verify product claims beyond requiring attestation. Merchants are solely responsible for food safety, accurate labeling, and compliance with all applicable laws.
7. Delivery
Delivery is provided by independent drivers. Farmly is not liable for delays, damage during transit, or driver conduct. Delivery fees go to the driver. Tips are optional and go entirely to the driver.
8. Limitation of Liability
Farmly is provided "as is." We make no warranties regarding product quality, availability, or delivery times. Farmly is not liable for any foodborne illness, allergic reactions, or other health issues resulting from products purchased through the Platform. Our total liability is limited to the amount you paid for the specific order in question.
9. Privacy
Your use of Farmly is also governed by our Privacy Policy.
10. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via email.
